Bookmemark.com (“Bookmemark”) is owned by Shanovouz Ventura private limited, a company incorporated and registered in Chennai, India.
By accepting these terms are conditions (“terms”), you are bound/ obligated to act under them and are responsible for all the actions performed within the bookmemark.com domain. If you do not wish to accept, you may refrain yourself from accessing the website, including but not limited to usage of content or services, downloading or any other activity that may involve Bookmemark in any way.
Failure to comply with the terms may result in suspension or termination of your access, blocking account or revoking of account registration. This will be upon the sole discretion of Bookmemark. You hereby agree to provide all genuine information at the time of account registration and beyond, as and when prompted to do so. Bookmemark reserves the right to change the terms and conditions at any point in time without notice. It will be your responsibility to check the terms and conditions regularly.
You will be solely responsible for your use of the Site and its Services. Bookmemark contains user-posted information/bookmark/content and Bookmemark makes no assurance in terms of the accuracy of information, level of obscenity or provoking content. The views, comments, opinions or beliefs solely belong to the users and Bookmemark is not responsible for the content of the linked websites or any other links in the linked websites. Bookmemark does not endorse any product/brand/ links/ linked websites/ content. The linked websites may contain offensive, provoking or obscene content, for which Bookmemark is not responsible and you may stop using the services, consequently.
- TRADEMARKS
Bookmemark, ‘Personal social Global’, and other Bookmemark graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks in India and other countries. Bookmemark’s trademarks may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion.
- INDEMNITY
You will indemnify and hold harmless Bookmemark, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys. fees and cost) from (i) any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms of Use by you, or the infringement by you, or any third party using your account or Bookmemark User ID, of any intellectual property or other right of any person or entity.
- CONDUCT OF USERS
As a user and as a part of the terms and conditions, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose, which maybe termed as illegal in the Jurisdiction of India or any other country.
By way of example, and not as a limitation, you agree not to use the Services:
- To abuse, harass, threaten, impersonate or intimidate other Bookmemark users;
- To post or transmit, or cause to be posted or transmitted, any Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive or otherwise violates any law or right of any third party;
- For any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
- To post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any Bookmemark user;
- To create or submit unwanted email ("Spam") to any other Bookmemark users or any URL;
- To violate any laws in your jurisdiction (including but not limited to copyright laws);
- To submit stories or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing stories (source hops), or off-topic content;
- You will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site;
- With the intention of artificially inflating or altering the 'Bookmemark count', blog count, comments, or any other Bookmemark service, including by way of creating separate user accounts for the purpose of artificially altering Bookmemark's services; giving or receiving money or other remuneration in exchange for votes; or participating in any other organized effort that in any way artificially alters the results of Bookmemark's services;
- To advertise to, or solicit, any user to buy or sell any products or services. It is also a violation of these rules to use any information obtained from the Services in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent;
- Attempt to impersonate another user or person;
- Sell or otherwise transfer your profile.
- REGISTRATION OBLIGATIONS
As a condition to using Services, you are required to register with Bookmemark and select a password and screen name ("Bookmemark User ID"). You shall provide Bookmemark with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your Bookmemark account. You may not (i) select or use as a Bookmemark User ID a name of another person with the intent to impersonate that person; (ii) use as a Bookmemark User ID a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as a Bookmemark User ID a name that is otherwise offensive, vulgar or obscene. Bookmemark reserves the right to refuse registration of, or cancel a Bookmemark User ID in its discretion. You shall be responsible for maintaining the confidentiality of your Bookmemark password.
Services are available only to individuals who are at least 15 years old, whether acting on their own behalf or as an authorized employee or representative of a corporation or other business entity. If you do not so qualify, do not attempt to register for or use the Services.
Bookmemark reserves the right to alter/remove any content/design/logo at any time, with or without notice based on complains/claims/ allegations from third parties related to that content. - COPYRIGHT COMPLAINTS
- Bookmemark acknowledges the intellectual property of others, and we request the users to do the same. Bookmemark reserves the right to suspend or terminate the access of and take other action against users, subscribers, registrants and account holders who infringe the copyright rights of others at appropriate circumstances and at its discretion.
- If you have a reason to believe that your work has been copied and is accessible on the Website in a way that constitutes copyright infringement, or that the Website contains links or other references to another online location that contains material or activity that infringes your copyright rights, you may notify Bookmemark.com with sufficient supportive evidence. The supportive evidence required would be detailed as per the level of infringement, after reporting of infringement to Bookmemark. Bookmemark at its discretion and sound judgment will remove/alter such content disputed to have infringed, after the above process is completed.
- JURISDICTION
Bookmemark makes no representation that materials on the Website are appropriate, available or legal in any particular location. Those who choose to access the Website do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. You agree that this Agreement, for all purposes, shall be governed and construed in accordance with the laws of Republic of India, applicable to contracts to be wholly performed therein, and any action based on, relating to, or alleging a breach of this Agreement must be brought only in a court in the city of Chennai, India.
- DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY
YOU ACKNOWLEDGE THAT YOU ARE USING BOOKMEMARK.COM AT YOUR OWN RISK. THE WEBSITE IS PROVIDED "AS IS", AND THE SERVICE PROVIDER, ITS AFFILIATES AND ITS THIRD PARTY SERVICE PROVIDERS HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, TITLE, MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION CONTAINED THEREIN OR PROVIDED BY THE WEBSITE. SERVICE PROVIDER, ITS AFFILIATES, AND ITS THIRD PARTY SERVICE PROVIDERS DO NOT REPRESENT OR WARRANT THAT ACCESS TO THE WEBSITE WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED ON THE WEBSITE OR THERE MIGHT BE LOSS OF DATA
